About these Terms and Conditions
In these Terms and Conditions "we" and "us" mean The Justin Drew Magatelli as trustee for JD Magatelli Unit Trust trading as LED Glow Illumination ABN 59 935 963 941 of 140 Hay Street Subiaco, Western Australia 6008, and "you" means you the customer. "Product" means any goods purchased on www.glowglow.com.au
These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email.
Australian Sales Only
We sell and ship Products purchase on this website only within Australia. We will not make deliveries outside of Australia.
If you are wanting to order our products from outside of Australia please contact us and we will process an order for you manually.
Legal Capacity to Transact
If you are under the age eighteen (18) years you cannot place orders with LED Glow Illumination. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
Should LED Glow Illumination suffer any damage or other losses as a result of a transaction entered into by a minor, LED Glow Illumination reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with LED Glow Illumination.
Placing your Order
You may place an Order by filling in the Order Form on the LED Glow Illumination Web Site and clicking the "Submit My Order" button.
When you place your Order, we will issue you with an Order Number. We will do this by email.
By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. Information contained on the LED Glow Illumination website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any Products; however LED Glow Illumination will make every effort to supply Products to you. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. LED Glow Illumination and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.
Payment methods and processing
LED Glow Illumination currently accepts Visa, MasterCard, American Express and PayPal only. Payment processing will not begin until we receive all the information we need. Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding Public holidays. We process credit card payments after you click the "Submit My Order" button. For credit card payments we will email a tax invoice to you with your Order Confirmation. Your tax invoice is your proof of purchase. PayPal payments take longer to process and this will delay the shipping time to you by up to five (5) days in addition to the regular shipping times.
- We are unable to accept credit cards issued by banks outside of Australia.
- You may be required to provide further identification for additional security reference checks.
All fees and charges identified in these terms and conditions and all prices for the products purchased on the LED Glow Illumination website include GST, where applicable.
LED Glow Illumination always seeks to list Products with the most competitive prices. LED Glow Illumination reserves the right to change prices for products displayed at LED Glow Illumination at any time before you place an Order. The price of products shown includes freight to all areas in mainland Australia.
The price of products shown includes freight to all areas in mainland Australia. This includes both metropolitan and regional areas in the following states and territories; WA, SA, VIC, TAS, ACT, NSW, QLD and NT. Some remote regional areas may take longer to deliver to, than our standard delivery times.
Supply of Your Products
Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation. When your Order items have been dispatched, we will email you to confirm shipment of each item including a tracking number for each item if available.
When placing your order it is important that you fill in all the required information including a telephone number. If you do not supply all of the required information, our courier company will be unable to accept the items for delivery until all the information is supplied. This can delay the shipping time to you.
Delivery of Your Products
Delivery time takes up to 10 working days from the date your payment is received. The estimated delivery time is in business days (Monday through Friday) excluding Public holidays. Although every effort is made to ship your order according to the estimated delivery time, this may change due to changes in supply or circumstances beyond our control. If your order has not arrived after the estimated delivery time, please contact us.
Unless otherwise agreed by us, we will deliver your Order to the shipping address indicated on your Order Confirmation (Excluding PO Boxes). If no-one is available to take delivery of your Products, our carriers will leave a card so you can pick-up your Order from your nearest delivery centre location. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery.
Failure to fill in the shipping details in full, including a contact phone number or using a PO Box address, will delay the delivery of your order, as our carriers require this information to complete the delivery.
We will use our reasonable efforts to deliver your Order to you within the estimated delivery time indicated on your Order Confirmation; however, we do not guarantee that we will deliver within this time frame. Title and risk of loss to all Products will pass to you on delivery.
Delivery of pre-order or special order products
Delivery times for pre-order products are set out on the product page for each item that is available as a pre-order. LED Glow Illumination will process these orders as quickly as possible to deliver within the set-out delivery time frame, but is not responsible for delays in product arrival due to issues that are outside of our control such as customs and inbound shipping delays.

Damage to products during the delivery process
Customer satisfaction is our number one priority at Glow and any problems that you may experience with your Glow product will be rectified with priority. If you recieve your Glow product and it is damaged or faulty from the shipping process we will arrange for your product to be replaced or a refund or store credit will be issued if a replacement is not available. If you receive a damaged item, please notify us within 48 hours here and we'll take care of the rest.
Instructions given to Glow by you on the delivery of your products are made by request only and we can not guarantee that your request will be followed by our shipping contractors. We are unable to provide additional delivery services such as calling prior to delivery or delivery at a set time. If you require this service please contact us here prior to ordering so that we can enquire what other suitable delivery service may be available and at what additional cost to you.
LED Glow Illumination in its absolute discretion may from time to time provide discount Coupons to existing and/or new customers. Coupons can only be used towards the payment of Products on our website. Coupons can only be used in accordance with the Terms and Conditions under which the Coupons are issued. Any Terms and Conditions governing the use of a coupon will accompany that Coupon. LED Glow Illumination will determine the content of Terms and Conditions governing Coupons in its absolute discretion. Where a Coupon is used towards the payment of a Product (or Products):
1. There may be an outstanding balance due on the Product; and
2. In the event that you have insufficient Credits in "Your Account", you must thereafter pay any outstanding balance due on the Product by Visa, MasterCard or American Express.
Consumer guarantees apply under the Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those guarantees. For more information about your rights as a consumer, see the Australian Consumer Law website at www.consumerlaw.gov.au.
If a Product has a minor defect, we will provide a repair or offer you a replacement or a refund. If a Product has a major defect, you are entitled to:
- Reject the goods and receive a refund
- Reject the goods and receive an identical replacement, or one of similar value if reasonably available
- Have the goods repaired, if a repair is available on the goods
- Keep the goods and receive compensation for the drop in value caused by the problem.
- If you think that a Product is defective you should contact us and a LED Glow Illumination Customer Service Representative will assist you. A photo may be requested to assist with the assessment of your claim. Where a Product is defective and needs to be replaced or repaired return shipping will be arranged at the expense of LED Glow Illumination. If a Product is replaced, your replacement Product becomes your property and the returned Product becomes our property. When a refund is given, the returned Product becomes our property. Refunds or replacement product will not be issued until the defective goods are received by LED Glow Illumination.
LED Glow Illumination Warranties
LED Glow Illumination also offers a standard 1 year warranty against defects on all Products. This is our warranty. You also have consumer guarantees under the Australian Consumer Law (see above).
If you believe that a LED Glow Illumination Product has an unsatisfactory defect, please contact us for assistance. LED Glow Illumination will then determine whether to make a refund or provide a repair or replacement. We encourage the notification of claims under this warranty within 90 days by offering to pay for the return of a Product where a claim is notified within that time and we determine that the Product is defective. Other cases will be considered on their merits. Where claims are made more than 90 days after delivery, we will need full details about the way the Product has been used and it may be necessary for us to make further enquiries. Where a refund is given for a product, and the claim is not covered by a consumer guarantee, it may be given as a Refund Credit to Your Account.
Replacement Products are covered by the same LED Glow Illumination warranty as well as by consumer guarantees (see Consumer Guarantees above).
Returning a Product if You Change Your Mind
If you change your mind about a purchase or make an incorrect choice, we may at our discretion provide you with a store credit within 14 days of delivery for unopened products. This credit does not include return delivery costs.
Return Authorisation Number - Required
A Return Authorisation (RA) number is required for replacement Products and refunds.
Where Customer Service has provisionally determined that a Product is defective, Customer Service will issue you with an RA. Products cannot be returned without an RA. The Product should be returned to LED Glow Illumination within 30 calendar days of the issuance of the RA. Where possible, all Products should be packed in the original, unmarked packaging including all accessories, manuals, documentation and registration that shipped with the Product. If the accessories are not included, only a partial refund will be applied.
Organising the Return of Products
Products must be returned whenever we agree to provide you with a refund or replace the Product.
Where you have received a defective Product, we will make arrangements with our courier service for collection of the Product, and will notify you when they will collect the Product from you. Pickup times are between 9am and 5pm, Monday to Friday. Customer Service will email you a PDF voucher containing an RA which you must affix to the product.
When a Replacement Product is arranged
A replacement for the same Product that you ordered will be shipped to you at our expense after we have received your returned Product.
- The delivery time for the replacement Product will be the same as stated for the original Product.
To the extent permitted by law:
- We will not be liable for any loss of income, loss of profits, loss of contracts or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
- Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
Your Personal Information
Credit Card Fraud
While LED Glow Illumination employs Secure Sockets Layer (SSL) technology software for its transactions with our customers, LED Glow Illumination will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
Fraud Protection and Prevention Procedures
When you place your Order by a Credit Card you may be sent an email from our Fraud Prevention Officer requesting further information, such as a copy of your credit card and drivers license for identification. After verification this information will be destroyed. In this case, until your order has passed internal Fraud Prevention procedure checks your order will remain on Pending status. If you do not provide the requested information within 7 days, your order will be cancelled and your payment will be refunded back to the method in which you paid. These information requests are sent to help protect Credit Card account holders from online Fraud.
You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of LED Glow Illumination. Any unauthorised assignment shall be deemed null and void. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby. Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition. LED Glow Illumination reserves the right to change the Terms and Conditions of sale at any time. No LED Glow Illumination employee or agent has the authority to vary any of the Terms and Conditions governing any sale.
To the extent permitted by law, LED Glow Illumination is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of LED Glow Illumination, and LED Glow Illumination shall be entitled to a reasonable extension of time for the performance of such obligations.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia and shall be subject to the non-exclusive jurisdiction of the courts of Western Australia.
